Terms and Conditions

1. Scope and Purpose

These Terms and Conditions (the "Terms") govern the use of analog media digitization services provided by Kilobyteivore合同会社 (the "Company"). By applying for our services, the customer agrees to be bound by these Terms in their entirety.

Our operations are conducted in accordance with the Act on the Protection of Personal Information (APPI), the Act on Specified Commercial Transactions, and the Consumer Contract Act of Japan.

2. Booking and Application

Customers may apply for services via the website contact form or by calling 06-4804-0117. The Company will respond to all inquiries within 24 hours.

Once a booking is confirmed, the customer is requested to send or bring in the original media. For risks associated with shipping and handling, please refer to our Legal Notice.

3. Pricing and Consumption Tax

Service fees are based on the Company's current price list. All displayed prices include the mandatory 10% consumption tax (税込).

Fees are calculated based on the number of tapes, meters of film, or total restoration hours. For a detailed breakdown of how we estimate costs, please visit Understanding Pricing and Estimates.

4. Payment and Deposits

To secure a production slot, the Company requires a deposit equal to 30% of the total estimated cost. Work will formally commence only after this deposit has been confirmed.

The remaining balance is due upon completion of the work, prior to or at the time of delivery of the final digital assets.

5. Delivery and Express Processing

The standard turnaround time is 14 business days from the date the original media is received. This period may vary depending on the physical condition of the media or current order volume.

Customers requiring urgent delivery may request express processing. This service is available for an additional fee of 50% of the standard rate. Specific deadlines will be coordinated individually.

6. Cancellations and Revisions

Cancellations made after work has commenced are not eligible for a refund of the deposit. Requests for specification changes (such as changing file formats) after digitization is complete will incur additional charges.

If a clear defect in the output is identified, the Company will re-process the media free of charge, provided the claim is made within 7 days of delivery.

7. B2B Transactions (Corporate)

For corporate clients (B2B), payment terms are 30 days from the date of invoice issuance. Where a separate service agreement is required, it shall be concluded alongside a DPA (Data Processing Agreement) regarding the handling of personal data.

8. Ownership and Data Rights

Copyright and ownership of the digitized results remain with the owner of the original media. The Company will not provide or publish these results to third parties without explicit consent.

The Company maintains backup copies of delivered data for 30 days. Following this period, all copies are permanently deleted in accordance with the APPI. Customers are responsible for their own long-term archiving.

9. Prohibited Activities

The following activities are strictly prohibited:

• Digitizing copyrighted commercial content, including retail movies, music CDs, or television broadcasts.
• Using the service to bypass or remove copy protection (DRM).
• Requesting the digitization of media that infringes upon the rights of third parties.

If such activities are detected, the Company will immediately cease service and return the original media.

10. Liability and Governing Law

While the Company employs every effort to ensure quality, we cannot guarantee perfect restoration for media suffering from severe degradation (mold, magnetic loss, etc.). Shipping accidents are handled according to the carrier's regulations.

These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising from these services shall be subject to the exclusive jurisdiction of the court in Osaka City Kita-ku.
